General Terms and Conditions of Sale – Genaya Stories

1. Purpose and Scope
These General Terms and Conditions of Sale (hereinafter "GTC") define the rights and obligations of Genaya Stories (hereinafter "the Seller") and any individual customer ("the Customer") in connection with the online sale of personalized children's books on the website genayastories.com (hereinafter "the Site"). These GTC apply to all product orders placed by individual consumers on the Site. Any order placed on the Site implies unreserved acceptance of these GTC. The Customer acknowledges having read the GTC prior to placing their order and having retained a copy (print or digital save).
Note: The products sold on the Site are intended exclusively for personal and non-commercial use. The Seller reserves the right to refuse any order deemed abnormal (e.g., large quantities suggesting professional use or resale).

3. Product Characteristics
Genaya Stories offers personalized picture books where your child becomes the hero of the story. The main features of the books are as follows:

AI personalization: Each book is created from information provided by the Client (child's first name, photo, description of the cuddly toy, etc.), thanks to artificial intelligence generating unique illustrations in the image of the child.

Format and Quality: The books have 24 color illustrated pages, with a hard cover in A5 format. They are printed in France on quality paper, with a glossy lamination for better durability.

Stories adapted for children: The catalog includes several original stories (e.g., The Archipelago of Emotions, The Star Thief, In Search of Teddy, etc.), designed to delight children and become cherished family memories. Each story is adapted to the child's age and conveys positive messages.
The photographs, descriptions, and visuals of the products displayed on the Site are for illustrative purposes only. Genaya Stories strives to present and describe each book as accurately as possible. However, slight variations in rendering (particularly in color or layout) may occur between the digital preview and the printed product, without affecting the quality or content of the story. The Customer acknowledges that the generated illustrations may differ slightly from the provided photograph while maintaining a faithful likeness.
4. Customization and Ordering Process
4.1 Creating the Personalized Book
To order a book, the Customer follows the personalization process on the Website:

Story selection: The Client selects the story or title they wish to personalize from the collection offered.

Adding personalized information: The Client provides the child's first name, uploads a clear photo of the child (front view, without nudity or inappropriate content), and a brief description of the child's favorite toy or cuddly toy. This information will be used to generate the child's avatar and their cuddly toy in the story. The Client guarantees that they have the necessary rights to the provided photo (including authorization from the child's legal guardian if required) and that it does not infringe on the rights of any third party. The Seller reserves the right to refuse any personalization containing an image or text deemed inappropriate (illegal, offensive, unsuitable for children, etc.).

Visual style selection: The Client chooses a visual style for the book's illustrations (for example: soft 3D animation style or poetic manga style). This choice determines the aesthetic of the AI-generated images for the story.

Preview: Once the information is entered, the Customer receives a free online preview of their personalized book, including the personalized cover and a preview of the first illustrated scene. This preview allows the Customer to check the final product (appearance of the child's character, the cuddly toy, graphic style, etc.) and to detect any errors (e.g., misspelling of the name, inappropriate photo, etc.). The Customer can then adjust the personalization elements if the result is not satisfactory (for example, try a different photo). No surprises: The Customer sees an excerpt of the book before ordering.
4.2 Order Validation
After personalization, the Customer can add the book to their cart and proceed with the order:

Order Summary: The Customer checks the details of their shopping cart (chosen title, child's first name, quantity, unit price, delivery charges, etc.) and can correct any errors. It is the Customer's responsibility to ensure that all personalization information is correct (spelling of the first name, photo quality, etc.) before confirming the order. Genaya Stories cannot be held responsible for personalization errors attributable to information provided by the Customer.

Acceptance of the Terms and Conditions: Before finalizing, the Customer must confirm their agreement with these Terms and Conditions of Sale (checkbox or equivalent statement).

Payment: The Customer is then redirected to the secure payment step (see Article 5 below). Once payment is confirmed, the order is registered.
Once payment is validated, the Customer receives an order confirmation email summarizing their order (details of the personalized book, quantity, amount charged, delivery address, chosen delivery method, etc.) as well as a copy of the Terms and Conditions or a link to access them. The sales contract is then formed.
Note: After validation and payment, no modification or cancellation of the order by the Customer is possible, given the personalized nature of the product (see Article 7 regarding the absence of a right of withdrawal). The book immediately enters the production phase.
The Seller reserves the right to refuse any order for legitimate reasons, such as non-compliance with these Terms and Conditions, an anomaly found in the order, payment failure, or a foreseeable problem concerning delivery. In the event of order refusal, the Seller will inform the Customer as soon as possible and will refund any sums received.
5. Price and Payment Terms
5.1 Price
Product prices are shown in euros (€), inclusive of all taxes (VAT included at the rate applicable in France). The applicable price is the one displayed on the Website at the time of the order. Genaya Stories may change its prices at any time, but the price charged to the Customer will always be the one displayed at the time the order is confirmed.
The prices shown do not include delivery charges, which are added when you select your delivery method (see Article 6 below). Delivery charges vary depending on the chosen method and destination and are clearly indicated before final order confirmation.
In the event of a promotion or special offer, the conditions of validity (dates, available stock, etc.) will be specified on the Site.
5.2 Payment
Payment for purchases is made in euros at the time of order, using one of the secure payment methods accepted by Genaya Stories. Available payment methods include, but are not limited to:

Credit card (Visa, MasterCard, etc.): via the secure Stripe payment platform integrated into the Site. Payment information is transmitted in encrypted form (SSL) and is not stored by the Seller.

Apple Pay: for customers with this service, enabling fast payment via compatible Apple terminals.

Shop Pay (Shopify): accelerated payment solution offered on the Site, allowing the Customer to use the payment information saved in their Shopify account for faster payment.
(Note: Depending on the Client's browser or device, other instant payment methods such as Google Pay or PayPal may be offered if activated on the Site.)
The customer's card or payment method will be debited upon order confirmation (unless explicitly stated otherwise for deferred payment). If the payment is declined by the bank, the order will be automatically cancelled and the customer will be notified. The seller is not obligated to deliver the order in the event of non-payment.
5.3 Payment Security
Genaya Stories places great importance on transaction security. Online payments are processed by trusted third-party payment platforms (Stripe, Apple Pay, etc.) and use industry-standard security and encryption protocols. No confidential banking information (card number, security code) is stored on the Site. In the event of fraudulent use of their bank card, the Customer is urged to contact their bank and the Seller immediately.
A detailed invoice can be provided to the Customer upon request, summarizing the price of the products and any delivery charges, as well as the applicable VAT.
6. Delivery
Genaya Stories offers several tracked delivery options to ship personalized books to the address provided by the customer during checkout. The available options, estimated delivery times, and base prices are as follows:

Express Delivery (tracked): Estimated total delivery time: 4 to 6 business days (including book production time + delivery). The fastest option, ideal for urgent gifts.

Standard Delivery (tracked): Estimated total delivery time: 6 to 8 business days. A balanced choice between speed and cost.

Tracked Mail: Estimated total delivery time: 7 to 9 business days. Economy option, with package tracking.
Delivery charges: prices start at €7.55 including VAT for the most economical option. The exact charges are calculated based on the chosen delivery method and the delivery destination (mainland France or abroad as applicable) and will be clearly displayed before order confirmation.
Delivery area: Genaya Stories primarily delivers to mainland France. For deliveries to other countries or territories (French overseas departments and territories, Europe, international), availability and delivery times may vary. Customers are advised to consult the Website or contact the Seller to learn about any international delivery options available. Additional charges (customs duties, import taxes) may apply for deliveries outside the EU; these charges remain the responsibility of the Customer.
Delivery Terms: Orders are shipped to the address provided by the Customer. It is the Customer's responsibility to provide a complete and accurate address. Upon shipment, the Customer receives a shipping confirmation email containing a tracking number, allowing them to track the package on the carrier's website. Delivery is considered complete upon delivery of the product to the Customer (or a third party designated by them).
Delivery Times: The delivery times indicated above are calculated in business days (excluding weekends and public holidays) from the order confirmation date. Genaya Stories makes every effort to meet these delivery times. However, they are estimates and may exceptionally be extended in the event of high demand (e.g., holiday periods) or logistical issues beyond the Seller's control (carrier delays, weather conditions, etc.). Any delay beyond the estimated delivery time does not automatically entitle the Customer to cancellation or compensation, unless the delay exceeds 30 calendar days after the estimated delivery date, in which case the Customer may cancel the sale in accordance with Article L216-2 of the French Consumer Code and obtain a refund.
Receipt: Upon receiving the package, it is the Customer's responsibility to check the condition of the packaging and the book. In the event of a damaged package (open package, damaged book) or a missing item, the Customer should, if possible, make specific reservations with the carrier (for example, refuse the damaged package or have the damage noted) and inform Genaya Stories customer service within 48 hours of delivery. Genaya Stories will then work to find a suitable solution (reprint, reshipment, or refund, see Article 8).
Transfer of risk (loss or damage to the product): This transfer occurs only when the Customer or a third party designated by them takes physical possession of the book. Until this actual delivery, the risks are borne by the Seller. The Seller cannot be held responsible for delays or delivery failures due solely to the Customer (incorrect address, prolonged absence, failure to collect the package, etc.). In this case, if the package is returned to the sender, the Seller may offer to reship it at the Customer's expense.
7. No Right of Withdrawal
In accordance with current regulations, the statutory 14-day right of withdrawal does not apply to products sold on the Site, as these are clearly personalized goods made to the Customer's specifications (Article L221-28 3° of the French Consumer Code). Since each book is custom-made (name, photo, and characteristics specific to the child), it cannot be reused or resold by the Seller in the event of cancellation.
Consequently, all sales are final upon order confirmation. The Customer does not have the option to cancel their order once payment has been made, nor to return the product for exchange or refund, except in the exceptional circumstances stipulated in Article 8 (error attributable to the Seller or defective product).
The Customer is therefore advised to carefully review their book design (preview, personalized text, chosen photo) before confirming their order. By confirming the order, the Customer expressly waives their right of withdrawal due to the product's personalization. This waiver is confirmed during the ordering process (checkbox or specific statement indicating acceptance of the absence of a right of withdrawal for a personalized product).
This clause does not affect the Customer's legal rights in the event of non-conformity or hidden defects in the delivered product, as detailed below. Genaya Stories also undertakes to take the necessary steps to resolve any problem in accordance with the following article.
8. Claims, Warranties and After-Sales Service
Customer satisfaction is our priority. While returns for change of mind are not possible (see Article 7), Genaya Stories provides responsive after-sales service in case of any order-related issues.
8.1 Claims for error or defect
If, upon delivery, the Customer notices a printing quality defect, an error in the book's content compared to their order (e.g., the book received does not match the confirmed personalization), or any other problem rendering the product unfit for its intended use, they are asked to contact the Seller as soon as possible after receipt. The complaint can be made via the Website's contact form or by email, attaching, if possible, photographs illustrating the problem encountered.
After verification, Genaya Stories will offer a suitable solution to the Customer, such as: free reprinting and reshipment of a corrected copy of the book, or a refund of the price paid if reprinting proves impossible or unnecessary. The appropriate solution will be chosen in consultation with the Customer on a case-by-case basis. As a general rule, if the defect is proven to be attributable to the Seller, reprinting or a refund is offered free of charge to the Customer.
8.2 Legal Guarantees
Regardless of the above contractual provisions, the Seller remains bound by the legal guarantees towards the consumer Client, namely:

Legal guarantee of conformity (Articles L217-3 et seq. of the French Consumer Code): The Seller will deliver goods that conform to the description in the contract and are free from defects. In the event of a lack of conformity existing at the time of delivery of the product (e.g., missing pages, major printing defects, etc.), the Customer has two years from receipt to take action and may obtain repair or replacement of the goods. If repair or replacement is impossible or disproportionate, the Customer may obtain a refund. The Customer is not required to prove the existence of the lack of conformity within two years of purchase (except for second-hand goods).

Legal guarantee against hidden defects (Articles 1641 to 1649 of the Civil Code): The Customer may exercise this guarantee if the delivered product has a hidden defect rendering it unfit for its intended use, provided that the existence of the hidden defect is proven. In this case, the Customer may choose to return the goods and receive a full refund, or keep the goods and receive a partial refund.
These legal guarantees apply independently of any commercial guarantee that may be offered. For any claim relating to these guarantees, the Customer must contact Genaya Stories, which will process the claim in accordance with legal provisions.
8.3 Limitations
Warranty claims or requests are excluded in the following cases:

Customer error in personalization: incorrect information provided (e.g., misspelled first name) or poor-quality photo resulting in a disappointing print, not attributable to the Seller. The Seller prints the book based on the data validated by the Customer during the ordering process; therefore, the Seller cannot be held responsible for an unsatisfactory result due to incorrect information or a subjective choice by the Customer.

Normal wear and tear or misuse: Genaya Stories books are designed to be handled by children with normal supervision. Damage due to natural wear and tear after several readings, or to abnormal use (accidental tearing, exposure to water, etc.), is not covered.

Slight variations in color or cut resulting from the printing process: These minor variations are not considered defects of conformity as they do not alter the overall quality of the product.
In case of doubt or problem, the customer is always encouraged to contact customer service – “we always find a suitable solution” is our motto. Genaya Stories prioritizes satisfaction and will examine each individual situation in good faith.
9. Intellectual Property
The Site's content, as well as the elements created within the context of personalized books (story texts, generated illustrations, layout, cover, etc.), are protected by copyright and intellectual property laws. Genaya Stories and/or its partners (including text authors, illustrators, and AI technology providers) retain exclusive ownership of all such content and related rights.
9.1 Personal Use License
When a customer purchases a personalized book, they acquire the physical copy of the book as well as a private, non-commercial right to use its content. This means the customer is free to read the book, give it to the child in question, and share it within a family or private setting. However, the purchase of the book does not transfer intellectual property rights to the story or the illustrations themselves. The customer may not reproduce, publish, or commercially exploit the book's content (text, images, characters, design) without prior written authorization from Genaya Stories. For example, it is prohibited to scan the book and distribute it online, copy it to create derivative works, or use it for any commercial purpose whatsoever.
9.2 Protection of Site Elements
Similarly, all visual, textual, graphic elements, logos, trademarks, and graphic design elements present on the genayastories.com website are the property of Genaya Stories or are used with the permission of their respective owners. They may not be downloaded, extracted, reused, or modified without permission. The name “Genaya Stories” and its logo are registered trademarks. Any unauthorized reproduction or use of these elements constitutes infringement and is subject to civil and criminal prosecution.
The Client agrees to respect the intellectual property rights attached to the products and the Site. Genaya Stories may take any action to stop or penalize any infringement of its rights (for example, in the event of the unlawful reproduction of a personalized book).
10. Personal Data and Confidentiality
The processing of the Customer's personal data is governed by our Privacy Policy, which can be consulted on the Website. The key points concerning data within the framework of these Terms and Conditions are summarized below:

Data collected during the order: To process an order for a personalized book, Genaya Stories collects personal information such as the child's first name, the child's uploaded photo, the description of the cuddly toy, as well as the data necessary for payment and delivery (payer's first and last name, postal address, email, telephone).

Use of Personalization Data: The photos and descriptions you submit are used solely to generate your personalized book using our artificial intelligence technology. They are not resold or used for any other commercial or advertising purposes. The AI uses the photo as a reference to create the character illustration, but does not retain the original photo. Photos are securely stored during the creation process and then automatically deleted after the order is produced. Genaya Stories does not maintain a database of children's photos.

Order data retention: Transaction data (customer contact information, order details) is retained for the time necessary to fulfill the contract, manage the business relationship, and in accordance with legal requirements (accounting, warranty, disputes, etc.). This data is accessible to authorized Genaya Stories departments and service providers involved in order processing (printer, carrier, payment provider), solely for the purposes of their assigned tasks, and is subject to a confidentiality agreement.

Customer Rights: In accordance with the General Data Protection Regulation (GDPR) and the French Data Protection Act, the Customer has the right to access, rectify, erase, object to, and transfer their personal data. To exercise these rights or for any data-related questions, the Customer can contact the Data Protection Officer of Genaya Stories (contact details in the Privacy Policy).

Cookies: The Site may use cookies or similar technologies to facilitate navigation and the ordering process (shopping cart, personalization in progress, etc.). The Customer can configure their browser to refuse them, but this may impair the optimal functioning of the Site.

Security and confidentiality: Genaya Stories is committed to ensuring the security and confidentiality of its customers' personal data. No sensitive data (such as bank details) is stored directly by the Site. For more details, customers are invited to consult the Site's Privacy Policy.
11. Responsibility
11.1 Seller's Responsibility
Genaya Stories guarantees that the products sold conform to the description provided on the Website and to the specifications agreed upon during the ordering process (personalization validated by the Customer). Genaya Stories is liable for any breach of its contractual obligations, and within the framework of the legal guarantees mentioned in Article 8.
However, the Seller cannot be held liable in the following situations:

Misuse of the Site or service by the Client: for example, technical difficulties attributable to the Client's computer configuration, or failure to comply with personalization instructions (providing a photo that does not conform to the guidelines, etc.).

Temporary interruptions or bugs of the Site: Genaya Stories cannot be held responsible for damages resulting from the unavailability of the Site, fraudulent intrusion by third parties or the presence of viruses, although it implements standard security measures.

Delay or non-performance due to force majeure: Genaya Stories shall not be liable for any failures due to events beyond its reasonable control (natural disaster, postal strike, widespread internet outage, armed conflict, etc.) as defined by French case law. In the event of force majeure, performance of the contract shall be suspended for the duration of the event plus a reasonable period for resumption. If the impediment continues beyond a reasonable period, each party shall be free to cancel the current order without compensation, and the Client shall be reimbursed for any sums paid for the undelivered order.

Indirect damages: In any event, the Seller's liability is limited to direct and foreseeable damages suffered by the Customer in connection with the execution of the order. Genaya Stories shall not be liable for indirect or intangible consequences (such as lost profits, loss of opportunity, moral damages related to the use of the product, etc.).
Genaya Stories does not provide any additional guarantee of satisfaction other than those expressly stated. The "Satisfaction Guaranteed or Your Money Back" indication on the Site means that the Seller undertakes to remedy proven problems in accordance with Articles 7 and 8, but does not constitute recognition of an unconditional right of return beyond the framework defined in these Terms and Conditions.
11.2 Customer Responsibility
The Customer is responsible for the accuracy and completeness of the information they provide when placing an order. This includes, in particular:

Not to impersonate a third party or provide false information.

Carefully check the chosen personalization (text and photo) before validating.

Use the product as intended. The books contain small parts (pages, binding) and should be used under adult supervision for very young children. Genaya Stories cannot be held responsible for any damage resulting from improper use (e.g., allowing a toddler to chew on or tear the book).
By placing an order, the Customer declares that they have the full legal capacity to enter into this agreement under these Terms and Conditions.
12. Applicable Law and Dispute Resolution
12.1 Applicable Law
These General Terms and Conditions of Sale and the contract concluded between the Customer and the Seller are governed by French law. Consumer customers residing in another European Union country also benefit from the mandatory protective provisions of their national law under the Rome I Regulation (EC No. 593/2008).
The Site is available in French and transactions are conducted in French. In the event of a translation of the Terms and Conditions into another language, the French version shall prevail in case of any discrepancy in interpretation.
12.2 Complaints and Mediation
In the event of a dispute or dissatisfaction regarding a product or order, the Customer is encouraged to first contact Genaya Stories customer service to seek an amicable solution. Most complaints can be resolved quickly by contacting our support team (see Article 8 and contact details in Article 2).
If the response from customer service does not satisfy the customer, or if no amicable agreement is reached after a written complaint, the customer has the option of using a consumer mediator free of charge to resolve the dispute amicably. Genaya Stories, as a professional, offers access to a mediation service. The customer can contact the following mediator:

Alternatively, if another mediator is competent to handle Genaya Stories, their contact details will be provided on the Site or upon request. The mediator will attempt, independently and impartially, to reconcile the viewpoints in order to reach an amicable solution.
In addition, the European Commission provides consumers with an Online Dispute Resolution (ODR) platform accessible at https://ec.europa.eu/consumers/odr , facilitating the out-of-court settlement of online disputes.
12.3 Jurisdictional Competence
In the absence of an amicable settlement or mediation, any dispute relating to the application of these Terms and Conditions or to orders placed on the Website shall be brought before the competent courts in accordance with the rules of ordinary law. For a consumer Client, the courts of the defendant's domicile or the place of actual delivery of the product shall have jurisdiction, at the Client's choice (in accordance with Article R.631-3 of the French Consumer Code).
No clause in these Terms and Conditions shall deprive the consumer of the mandatory protection afforded by the provisions of the Consumer Code. If any provision of these Terms and Conditions is deemed illegal or unenforceable by a court, the other provisions shall remain in full force and effect.
13. Final Provisions
13.1 Entire Agreement
These General Terms and Conditions of Sale, the order summary, and the order confirmation constitute the entire contractual agreement between the parties. They express the full scope of the obligations of the Seller and the Customer. No document, condition, or indication not expressly included in these General Terms and Conditions of Sale or not expressly agreed to in writing by the parties shall be incorporated into the contractual framework.
13.2 Amendment to the General Terms and Conditions
Genaya Stories reserves the right to modify these Terms and Conditions at any time. In the event of modification, the applicable Terms and Conditions are those in effect on the date the order was placed by the Customer (a dated copy can be provided upon request). The new Terms and Conditions will, where applicable, be published on the Website with their effective date.
